The adventages of
the private detective and the lawyer's cooperation
To effectively complete the case which he is commissioned to do, the private detective has to be thoroughly acquainted with the regulations of the civil code, the Society Law and the Judiciary Enforcement, thus he will be able to achieve results which most suit the interests of the customers. Nothwithstanding, he can?t do without the professional advice of a lawyer who is thoroughly acquainted with the code of laws and has court-room experience.
As for me, I am in a favourable position, because the lawyer who helps me with my work, is my wife. We even share the same bureau. So I can assure you that when it comes to the legal judgement of your case which I am commissioned to solve, I will consult my wife on it daily if needed, and that will not mean additional expenses for you.(It will only be a single juristic advice, not an assignment of a lawyer or legal representation.)
In the case you decide that you don?t want my juristic advice which is part of my work; so if you don?t think it would be discreet enough and you prefer the habitual well-proved lawyer?s help, just tell me it and I will accept your request. Naturally it doesn?t mean that I wouldn?t be readily co-operating with your legal representative.
Why does a private detective need the help of a lawyer?
The work of the private detective is variegated. There are no two affairs alike. That means that there are cases which only need a private detective qualification, but there are more complex affairs: they require professional knowledge of law. These latter can only be achieved with the help of legal backing up which we mentioned above. But there are cases when the best thing to do is to employ the means of both professions.
What does this actually mean?
Let me show some examples from my own practice:
1.) A finance company is indebted to you, but in the meantime it was divided into two separate companies. How, in what way, from whom and on what legal ground will you be able to call in your money? Now who is indebted to you? The first and most important step is to properly consider the legal aspect of the case, because this is what the private detective?s work must be based on. He has to decide for whom he works. Whose property he is after? If a company is divided into two both its legal predecessor and legal successor are answerable for its debt. So after the examination of your documents and the matters of the firm, after a control on the spot the initiative in the firm?s liquidation or its execution can be taken, and besides these, even an inventory of property can be executed. So to do an effective work you need a steady legal background. Thus already at the beginning of your work you will be able to decide which is the best solution for you. A solution by which you can save money and spare time.
2.) Let me refer to another case: You win a case in a civil action, but there is no property to be executed, because the indebted company in the meantime turned into money everything. Now what can be done? (enter the property in an inventory, and thus I find document of estate realization transaction (which is legally justified by a lawyer) and a document of estate itself. Then you, the customer may decide whether to enter a civil action because of the withdrawal of property, or not. If the debt mounts up to some million forints you should consider it.
3.) Let us suppose that you have a divorce suit going on, and you would like precisely to know the financial situation of your partner marriage. What do I mean, what is it for? For example, whether he/she obtained movable or landed property, or business share, share certificate in some finance company during the years of your married life, but without letting you know it? Did a third person play a part in your marriage? If yes, it is the private detective?s task to find him/her. It is also his task to trace down a secretly obtained property and throw light on the finances. But how much of these you will get after the suit and the property sharing, whether you can enforce your claim to the money, or what kind of additional information, data, facts and documents are needed and have to be found so that your case can be settled with good results, only a lawyer will tell you precisely.
